B2G e-invoicing will be mandatory from 1 July 2021 for SMEs.
Portugal has just published newly revised e-invoicing regulations. The obligation to add a unique identification number (ATCUD) to each invoice has been delayed until January 1, 2022, one year later than originally scheduled. However, a QR code will be mandatory for both electronic and paper invoices.
The Portuguese government has taken this decision after analysing the resources companies will need to adapt to the ATCUD requirements. The authorities consider that given the current pandemic situation, companies will need to focus their resources on more urgent needs.
With this new revision, the period set to acquire the ATCUD code has also been delayed. Companies will thus begin the procedure as of the second half of 2021. From 2022 on, invoices lacking the ATCUD code will not be considered valid for tax purposes.
The e-invoice in Portugal
Following this revision, regulations for e-invoicing in Portugal are as follows:
- 1st January, 2021: B2G e-invoicing mandatory for large companies (over 250 employees, a turnover of over €50m, or an annual balance sheet of over €43m).
- 1st January, 2021: QR code. All invoices must include a QR code complying with the technical specifications as published by the government.
- 1st July, 2021: B2G e-invoicing mandatory for SMEs.
- 1st January, 2022: B2G e-invoicing mandatory for micro-enterprises.
- 1st January, 2022: ATCUD code mandatory on all invoices.
Digitization of invoices and the new requirements (QRs and ATCUD codes) have a dual objective. On one hand, Portugal wishes to simplify communications with the tax authorities. On the other, they hope to attain greater control of transactions carried out by the country’s taxpayers.
